These Terms & Conditions (“Terms”) apply to your use of netsuitehire.com (the “Site”) and the NetSuite talent matching services (the “Services”) provided by NetSuiteHire, a division of Versimarket LLC (“NetSuiteHire,” “we,” “our”). By using our Site or Services, you agree to these Terms. If you don’t agree, please don’t use the Site.
1. What We Do
NetSuiteHire is a specialized talent matching service. We connect companies (“Clients”) with pre-vetted NetSuite professionals (“Candidates”) for contract, contract-to-hire, and permanent engagements. Our services include sourcing, technical vetting, candidate matching, interview coordination, and placement support.
We are not the employer of the Candidates we place. The working relationship between Client and Candidate — including scope, deliverables, compensation, and duration — is governed by separate agreements.
2. Who Can Use Our Site
You must be at least 18 years old and legally able to enter into agreements. If you’re using our Services on behalf of a company, you confirm that you have authority to bind that company to these Terms.
3. Acceptable Use
When using our Site, you agree to:
- Use the Site only for lawful purposes related to hiring or being hired for NetSuite roles.
- Not attempt to access restricted areas of our Site, servers, or connected systems without authorization.
- Not use bots, scrapers, or automated tools to copy or monitor our Site content without written permission.
- Not upload or transmit malicious code, viruses, or anything designed to harm our Site or its users.
- Not impersonate any person or organization, or misrepresent your relationship with any person or organization.
We reserve the right to suspend or terminate access for anyone who violates these Terms.
4. For Clients
4.1 Submitting Requests
When you submit a hiring request, you agree to provide accurate information about your requirements, including the role, technical skills needed, project context, timeline, and engagement preferences. Accurate information leads to better matches.
4.2 Fees
NetSuiteHire’s fees are outlined in separate service agreements executed with each Client before a placement begins. Fee structures depend on the engagement type (contract, contract-to-hire, or permanent placement) and are not listed on the Site.
4.3 Non-Circumvention
If NetSuiteHire introduces you to a Candidate, you agree not to engage that Candidate outside of our agreed terms — whether directly or through another agency — during the engagement period and for 12 months after the engagement ends, unless we agree otherwise in writing.
4.4 No Performance Guarantee
We vet every Candidate rigorously — certifications, technical assessments, references, and portfolio reviews. However, we provide matching services, not performance guarantees. We cannot guarantee that any specific Candidate will deliver specific outcomes on your project.
5. For Candidates
5.1 Accurate Information
Candidates joining our network agree to provide truthful and complete information — including work history, NetSuite certifications, technical skills, and references. Misrepresenting your qualifications will result in removal from our network.
5.2 Verification Consent
By joining our network, you authorize NetSuiteHire to verify your NetSuite certifications through Oracle or other official channels.
5.3 Client Confidentiality
Candidates agree to keep confidential any Client information received during the matching process — including project details, business strategies, and internal data — unless the Client authorizes disclosure.
6. Our Content and Intellectual Property
Everything on our Site — text, design, graphics, logos, page layouts, and code — belongs to NetSuiteHire or Versimarket LLC and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without written permission.
“NetSuiteHire” is a brand name of Versimarket LLC. “NetSuite” is a registered trademark of Oracle Corporation. NetSuiteHire is not affiliated with, endorsed by, or sponsored by Oracle Corporation.
7. No Warranties
Our Site and Services are provided “as is.” We make no warranties — express or implied — about the availability, accuracy, reliability, or completeness of our Site or the suitability of any Candidate for your specific needs. We do our best, but we don’t make guarantees.
8. Limitation of Liability
To the fullest extent permitted by law, NetSuiteHire and Versimarket LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Site or Services — including but not limited to lost revenue, lost data, or damages resulting from a Candidate’s performance or non-performance.
Our total liability for any claim related to these Terms or our Services will not exceed the total fees you paid to NetSuiteHire in the 12 months before the claim arose.
9. You Agree to Indemnify Us
You agree to defend and hold harmless NetSuiteHire, Versimarket LLC, and our respective officers, employees, and agents from any claims, damages, costs, or expenses (including legal fees) arising from your use of our Site or Services, your violation of these Terms, or your violation of any third party’s rights.
10. Links to Other Sites
Our Site may link to third-party websites. We don’t control those sites and aren’t responsible for their content, privacy practices, or reliability. Use them at your own discretion.
11. Governing Law
These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles. If a dispute arises, both parties agree to attempt resolution through good-faith negotiation before pursuing arbitration or litigation in the courts of New York.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we’ll update the effective date at the top. Your continued use of our Site after changes are posted constitutes acceptance of the updated Terms.
13. Severability
If any part of these Terms is found unenforceable by a court, that part will be modified to the minimum extent necessary, and the rest of these Terms will remain in full effect.
14. Complete Agreement
These Terms, our Privacy Policy, and any separate service agreements between you and NetSuiteHire make up the entire agreement regarding your use of our Site and Services.
